1. DEFINITIONS AND TERMS
1.1. Service (Allyon) — an international online service for conversation with a software companion based on artificial intelligence, providing the User with the ability to hold a dialogue with the AI companion (including by voice), to set its name, role and manner of communication, to use the companion's memory, reminders and notes, to correspond with their own contacts in the "Friends" section, and, at their own choice, to import into the Service screens of other applications of the AI² Platform (AI² Fans, TwinCard, AI² Space).
1.2. Platform — the totality of software, databases, algorithms, artificial intelligence models, and infrastructure that ensure the functioning of the Service, including the website allyon.ai, the Allyon mobile application, server software, and integrated third-party services.

1.8. Companion Settings — the name, role and manner of communication of the AI companion chosen by the User.
1.9. Companion Memory — information that the AI companion saves about the User from conversations so that a conversation does not start from scratch each time. The User has the right to view and delete the saved information and to disable memory in the settings of the Service.
1.10. Reminders and Notes — reminders that the AI companion creates at the User's request (for example, "remind me…") and sends at the scheduled time, as well as the User's notes stored in the Service.
1.11. Voice Communication — the ability to address the AI companion by voice and to receive its replies in spoken form; voice messages are recognized and converted into text to generate a reply.
1.12. "Friends" — a section of the Service for the User's correspondence with other people whom the User has personally added to their contacts by exact username or identifier. Searching for people by name and browsing the User database are not provided in the "Friends" section.

1.17. Wallet — a section of the Account displaying the balance of AI² tokens of the Service and the transaction history (top-ups, debits, refunds), and providing access to top-up operations. The Wallet of the Service is separate from the wallets of other products of the Platform: funds deposited in another product are not used in the Service.
1.18. Digital Activation Code (Digital Cheque) — a unique alphanumeric code granting the right to top up the AI² token balance.

1.29. Imported Screen — a screen of another application of the AI² Platform (AI² Fans, TwinCard, AI² Space) that the User has, at their own choice, imported into the Service. The Service is a constructor: the set of screens is determined by the User.
2. GENERAL PROVISIONS
2.1. This Agreement constitutes a legally binding contract between the User and the Operator, concluded in electronic form through acceptance of the terms of the Agreement.
2.2. Acceptance of this Agreement is effected by the User performing any of the following actions:
• registration with the Service (creation of an account);
• authorization through third-party services (Google, Telegram);
• continued use of the Service following publication of amendments to the Agreement.
2.3. The Service is intended exclusively for individuals who have reached the age of 18 (eighteen) years. By registering with the Service, the User confirms having reached the specified age. The Administration reserves the right to request age verification at any time and to block the Account upon discovery of a violation of the age restriction.
2.4. The Service is provided on an international basis in accordance with applicable legislation, including but not limited to:
• Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR);
• Directive 2002/58/EC on privacy and electronic communications (ePrivacy);
• Directive 2011/83/EU on consumer rights;
• Directive 2000/31/EC on electronic commerce;
• Regulation (EU) 2022/2065 (Digital Services Act, DSA);
• Regulation (EU) 2024/1689 (Artificial Intelligence Act, EU AI Act);
• the national legislation of the User's country of residence.
2.5. The Service acts as an information intermediary and shall not be liable for the content and accuracy of information that the User posts in the Service, tells the AI companion or sends to their contacts in the "Friends" section.
2.6. The Service does not guarantee that the User will achieve any specific results from communicating with the AI companion. The AI companion's replies are informational and entertainment in nature and do not constitute professional medical, psychological, legal, financial or other advice; the Service does not replace consulting specialists.
2.7. The Service employs Domain-Based Jurisdiction technology, whereby the set of available features, content, and restrictions is determined by the domain through which the User accesses the Service, as well as the User's country of location. This international edition of the Agreement applies to the international domain allyon.ai and to the Application used in the international jurisdiction.
2.8. The Administration reserves the right to modify the functionality of the Service at any time, to add, change, or remove individual features, subject to notification of Users regarding material changes.
2.9. The User assumes the risks associated with using the Service, including the possible inaccuracy of the AI companion's replies and the risks of communicating with people whom the User has personally added to the contacts of the "Friends" section. The Administration takes reasonable measures to ensure User safety (moderation, a complaint and blocking mechanism); however, it cannot guarantee complete protection against fraud and bad faith behavior.
2.10. The Service is available in several languages. For international domains, the English-language version of the Agreement shall have legal force. In the event of discrepancies between language versions, the English-language version shall prevail.
2.11. The Platform is inclusive and welcomes Users of all gender identities and sexual orientations. Discrimination on the basis of sex, gender identity, sexual orientation, race, nationality, religion, or other characteristics is prohibited.
3. REGISTRATION, ACCOUNT, AND DELETION
3.1. Registration
3.1.1. To use the Service, the User must complete the registration procedure, which includes the following steps:
• providing an email address and creating a password, or authorization through supported third-party services (Google, Telegram);
• specifying a display name and date of birth (18+ age check);
• optionally — specifying the country and city (for the language and time zone), a phone number, an "About me" text, and uploading a profile photo;
• confirming acceptance of this Agreement and the Privacy Policy;
• giving consent to the processing of personal data in cases where processing is based on consent (in accordance with GDPR).
3.1.2. The Service does not conduct questionnaires or psychological testing of the User.
3.1.3. The User is obliged to provide accurate and up-to-date information during registration. Providing knowingly false information, including about age, constitutes grounds for blocking the Account.
3.1.4. Each User may create only one Account. Creating multiple accounts is prohibited and may result in the blocking of all associated accounts.
3.1.5. The User is solely responsible for the security of their credentials (login, password). The User is obliged to notify the Administration immediately of any unauthorized access to their Account.
3.1.6. Authorization through third-party services (Google, Telegram) is performed using OAuth 2.0 protocols. When authorizing through Telegram, if there is no email address in the Telegram profile, the Platform creates a technical email address.
3.1.7. No biometric face verification is carried out in the Service; no biometric templates are created or stored. The profile photo is stored as an ordinary image.
3.2. AI Companion Settings
3.2.1. The User has the right to give the AI companion a name, a role and a manner of communication. These settings are stored in the Account and used when generating replies.
3.2.2. The settings are voluntary: without them, the Service works with default parameters. The User has the right to change the companion settings at any time.
3.2.3. When setting the role and manner of communication, the User undertakes to comply with the rules of Section 6 of this Agreement. Companion settings may not be used to circumvent restrictions established by the Agreement and applicable law.
3.3. Companion Memory, Reminders and Notes
3.3.1. The AI companion remembers the course of the conversation and may save in memory information that the User has shared in conversations so that a conversation does not start from scratch each time.
3.3.2. The User has the right at any time to:
• view the information saved in the companion's memory;
• delete individual items of information or ask the companion to forget them;
• clear the memory entirely;
• disable memory in the settings of the Service — in this case, the companion neither uses nor adds to the memory, and the conversation history is kept as history but not as memory.
3.3.3. At the User's request, the AI companion creates reminders and sends them at the scheduled time into the conversation and (subject to consent) as a push notification. The time zone of the User's device is used to set the correct time for reminders. The User has the right to view and cancel the reminders created.
3.3.4. Reminders are created automatically based on the language model's understanding of the User's request. The User is responsible for checking that a reminder has been created for the right time. The Operator shall not be liable for the consequences of a reminder failing to trigger or triggering inaccurately; the Service is not intended for reminders on which life, health or property depend (for example, taking medication prescribed by a doctor).
3.3.5. Companion memory, reminders and notes are deleted upon deletion of the Account in the manner set out in clause 3.6 of this Agreement.
3.4. Voice Communication and Attachments
3.4.1. The User has the right to address the AI companion by voice. Voice messages are recognized and converted into text, which is used to generate a reply in the same way as a text message. The AI companion's replies may be voiced by a synthesized voice; such a voice is created by software and does not belong to a human being. Speech recognition and synthesis are performed on the Operator's servers. By default, the Service has no feature for creating one's own voice (see clause 3.10).
3.4.2. The User has the right to send attachments (images, voice recordings, documents) to the AI companion if the corresponding feature is available in the Service. Attachments are processed to generate a reply and are stored in the conversation history.
3.4.3. The User may not send the AI companion voice recordings, images and documents of third parties without a lawful basis, or materials prohibited by Section 6 of this Agreement.
3.5. Account Management
3.5.1. The User has the right at any time to edit profile data, change the profile photo and companion settings, manage the companion's memory, delete conversations and reminders, and manage contacts of the "Friends" section.
3.5.2. The User has the right to change the password of their Account in the profile settings. If the password is lost, the User may use the password recovery procedure.
3.5.3. The Administration has the right to block or restrict access to the User's Account in the event of a violation of the terms of this Agreement, receipt of justified complaints from other Users, detection of suspicious activity, or at the request of authorized government authorities. Upon blocking, the User is notified of the reasons and has the right to appeal the decision.
3.6. Account Deletion
3.6.1. The User has the right at any time to delete their Account in the Application ("Profile" → "Delete account") or by sending a request to the email address info@allyon.ai from the address with which the Account is registered. A reply to the request is sent within 30 (thirty) days.
3.6.2. The AI² account is single for all applications of the AI² Platform; therefore, deleting the Account closes the account entirely, not only in the Service.
3.6.3. Procedure and time frames for deletion:
• immediately after the request, the Account is hidden;
• a cancellation period of 30 (thirty) days applies: if the User signs in to the Account during this period, the deletion is cancelled and the data is restored;
• after 30 (thirty) days, the User's personal data is replaced with anonymized marks in accordance with Art. 17 of GDPR (right to be forgotten); it cannot be restored thereafter;
• anonymized records whose retention is required by applicable law are permanently deleted upon expiry of the statutory period.
3.6.4. Upon deletion of the Account, the following are deleted:
• the profile: name, photo, language and settings;
• conversations with the AI companion, including voice conversations, and attachments;
• the companion's memory — everything it has remembered about the User;
• reminders and notes;
• the User's contacts and correspondence in the "Friends" section;
• the sample of one's own voice and the voice created from it (if they were created through an imported screen).
3.6.5. Messages sent by the User to other people in the "Friends" section remain in the correspondence history of the recipients, since they are also part of the recipients' correspondence.
3.6.6. Upon deletion of the Account or removal of the Service from the account, the active subscription is cancelled with a refund of AI² tokens to the Wallet in accordance with clause 5.6.7. AI² tokens are not exchanged back into money, except in cases provided for by law; this does not restrict the above refund. A subscription purchased through an app store is governed by clause 5.6.9.
3.6.7. The Administration has the right to retain anonymized statistical data for the purpose of improving the Platform's algorithms (legal basis — Art. 6(1)(f) of GDPR, legitimate interest), provided that the User cannot be identified from such data.
3.6.8. The Administration has the right to retain data necessary for the fulfillment of legal obligations (Art. 6(1)(c) of GDPR) — accounting records, tax legislation — for the periods established by applicable law.
3.6.9. Before deleting the Account, the User has the right to exercise the right to data portability (Art. 20 of GDPR) and request an export of their personal data in a machine-readable format.
3.7. The "Friends" Section
3.7.1. In the "Friends" section, the User can correspond with people whom the User has personally added to their contacts by exact username or identifier. Searching for people by name, matching conversation partners and browsing the User database are not provided.
3.7.2. For correspondence in the "Friends" section, the User optionally fills in a chat profile (first name, last name, username, phone number, date of birth). The chat profile details become visible to the User's contacts only after the User has saved them.
3.7.3. Correspondence functions in real time using SSE (Server-Sent Events) technology. Messages are delivered when an active Internet connection is available.
3.7.4. The User receives notifications of new messages via push notifications (subject to consent) and as notifications within the Service. The User has the right to mute notifications for an individual conversation.
3.7.5. The "Clear history" and "Delete chat" functions apply only to the User: the correspondence is retained on the other party's side. A new message in a deleted conversation returns it to the chat list.
3.7.6. The Administration does not systematically monitor the content of private messages; however, it reserves the right to review the content of correspondence upon receipt of a complaint or where there are grounds to suspect a violation of this Agreement or applicable law.
3.7.7. The User has the right at any time to remove a person from their contacts, block them or file a complaint about them (Section 6).
3.7.8. If the User's contact is registered in the Platform's cabinet of another country, messages are also delivered to and stored on the Platform's servers in the country of the other party's cabinet to the extent necessary to deliver and display the correspondence (see Section 9.5).
3.8. Mobile Application and Push Notifications
3.8.1. The Service is available through the website and in the form of the Allyon mobile application, which may be installed on the User's device for convenient access. Notifications of the Service are also displayed within the Service.
3.8.2. When installing the Application or using the Website, the User is offered to grant permission to send push notifications. Consent to push notifications is voluntary (opt-in) in accordance with Directive 2002/58/EC.
3.8.3. Push notifications are used for:
• notifications of new replies from the AI companion and of reminders becoming due;
• notifications of new messages in the "Friends" section;
• notifications about the subscription and payments;
• informational notifications from the Service;
• promotional notifications (only with separate explicit consent).
3.8.4. The User has the right to withdraw consent to push notifications at any time through the settings of the browser, operating system, or the Service.
3.8.5. To ensure the operation of push notifications in the browser, the Service uses the Web Push protocol with content encryption (RFC 8291) and VAPID authentication; in the Application — the push notification services of mobile platforms.
3.9. Profile Photo
3.9.1. Uploading a profile photo is not mandatory and does not affect access to the Service. The photo is used to decorate the User's profile and is shown to the User's contacts in the "Friends" section.
3.9.2. The profile photo must meet the following requirements:
• photographs must not contain images of third parties without their consent;
• photographs must not contain explicitly sexual or pornographic content;
• photographs must not contain logos, advertising, or contact information;
• the use of photographs that impersonate another person, including those generated by artificial intelligence (deepfakes), is prohibited.
3.9.3. The Administration has the right to remove photographs that do not meet the requirements, notifying the User of the reasons for removal.
3.10. Screens of Other AI² Applications
3.10.1. The Service is a constructor: the User has the right, at their own choice, to import into the Service screens of other applications of the AI² Platform (AI² Fans, TwinCard, AI² Space) and to use them in the Service. The list of screens available for import is determined by the Operator and may change. The User has the right to remove an imported screen from the Service at any time.
3.10.2. When an imported screen is used, the corresponding feature is governed, in addition to this Agreement, by the user agreement and privacy policy of the application to which the screen belongs. In the event of a conflict regarding that feature, the documents of the relevant application apply, unless otherwise provided by this Agreement.
3.10.3. If, through an imported screen, the User uploads a sample of their voice to create a synthesized voice, the sample is processed solely to create that voice and use it at the User's request, is stored until it is deleted by the User or until the Account is deleted, and is not used to identify the User: no voice biometric templates are created. The User may upload only a sample of their own voice.
3.10.4. By default, the Service has no feature of its own for creating a voice; it becomes available only when the corresponding screen is imported at the User's choice.
4. END-USER LICENSE AGREEMENT (EULA)
4.1. Grant of License
4.1.1. The Operator grants the User a non-exclusive, non-transferable, revocable license to use the Service (including the website and the mobile application) in accordance with the terms of this Agreement.
4.1.2. The license is granted for the entire term of the Agreement and extends to all features of the Service available to the User in free mode or under a paid subscription.
4.1.3. The license is granted exclusively for personal non-commercial use.
4.2. License Restrictions
4.2.1. The User shall not:
• copy, modify, decompile, disassemble, or reverse engineer the Service software;
• create derivative works based on the Service;
• transfer, sublicense, lease, or otherwise provide access to the Service to third parties;
• use the Service to create a competing product or service, including to train third-party artificial intelligence models on the AI companion's replies;
• extract or reutilize substantial parts of the Service databases (in accordance with Directive 96/9/EC on the legal protection of databases);
• use automated means (bots, scripts, crawlers) to access the Service, extract data, or interact with the Service;
• circumvent or attempt to circumvent the technical protection measures of the Service and the limits of the free mode;
• exploit vulnerabilities of the Service.
4.3. AI Services
4.3.1. Within the scope of the granted license, the User has access to the Platform's AI services, including:
• the AI companion — dialogue in chat format and by voice, taking into account the companion settings and its memory;
• reminders created by the AI companion at the User's request;
• speech recognition and voicing of replies;
• processing of attachments sent to the AI companion.
The AI services run on the Operator's own language models deployed on the Operator's servers.
4.3.2. The AI services are based on large language model (LLM) technologies and do not replace professional psychological, medical, legal, or other assistance. The results of the AI services are informational and entertainment in nature.
4.3.3. The User acknowledges and agrees that AI services may generate inaccurate, incomplete, or erroneous results. The Operator shall not be liable for decisions made by the User based on the results of AI services.
4.3.4. Use of the AI services in free mode is limited by the number of messages per day; a subscription removes this limit (for details, see Section 5).
4.3.5. In accordance with Regulation (EU) 2024/1689 (EU AI Act), the User is notified that they are interacting with an artificial intelligence system and not with a human being. The AI services of the Service do not make decisions that produce legal effects for the User.
4.4. Updates
4.4.1. The Operator reserves the right to update the Service software, including bug fixes, addition of new features, interface changes, and algorithm improvements.
4.4.2. Updates of the Service may include changes to the language models used, the voices used for voicing, and the parameters for generating replies. Such updates are aimed at improving the quality of the Service and do not require the User's separate consent, provided they do not change the purposes and legal bases for processing personal data.
5. PAID SERVICES
5.1. General Provisions
5.1.1. The Service provides a free mode and a paid subscription. The subscription is paid in AI² tokens from the Wallet of the Service or through an app store (App Store, Google Play).
5.1.2. The AI² Token is not electronic money, cryptocurrency, a security, or any other financial instrument. The AI² Token is a notional unit for accounting for the volume of paid services, cannot be exchanged for money and cannot be withdrawn from the Platform.
5.1.3. The conversion rate of AI² tokens to EUR and USD is set by the Operator and published on the Website. The Operator reserves the right to change the conversion rate with prior notification to Users at least 14 (fourteen) days in advance.
5.1.4. The Wallet of the Service is separate from the wallets of other products of the AI² Platform: AI² tokens deposited in another product are not used in the Service, and vice versa.
5.2. Methods of Topping Up the AI² Token Balance
5.2.1. The User may top up the AI² token balance through the following methods:
• Fiat payments: bank cards (Visa, Mastercard) through certified payment gateways. Payment is made in EUR or USD with conversion to AI² tokens at the current rate.
• Digital activation codes (cards and flyers): alphanumeric codes purchased from authorized partners or received as part of promotional campaigns.
• Other methods: may be added by the Operator and indicated on the Website.
5.2.2. Balance top-ups are irrevocable. After AI² tokens have been credited to the User's balance, no refund is made, except in the cases provided for by Section 5.5 and applicable consumer protection law. This rule does not restrict refunds of the subscription price in AI² tokens to the Wallet under clauses 5.6.6–5.6.8.
5.2.3. In accordance with Directive 2011/83/EU on consumer rights, the User has the right to withdraw from a contract for the supply of digital content or a digital service within 14 (fourteen) days of purchase (right of withdrawal), provided that the provision of services has not yet begun. By starting to use paid services, the User consents to the immediate commencement of their provision and acknowledges being aware of the loss of the right of withdrawal.
5.3. Free Mode and Subscription
5.3.1. In free mode, the User has access to a limited number of messages to the AI companion per day. The current limit is displayed in the Service.
5.3.2. The Service has a single subscription that differs only in its period: 1 month, 3 months, 6 months or 12 months. There are no levels (pricing tiers). The subscription removes the free-mode limit on the number of messages per day. The subscription price for each period is given in Appendix 1 to this Agreement.
5.3.3. The subscription price is stated in AI² tokens for the relevant period. The EUR/USD equivalent is calculated at the current conversion rate published on the Website. The current periods and prices are displayed in the Service and take precedence over Appendix 1.
5.3.4. Automatic renewal and its disabling, cancellation of the subscription and refunds of AI² tokens are governed by clauses 5.6.3–5.6.6.
5.3.5. The Operator has the right to change the subscription price and its terms with prior notice of at least 14 (fourteen) days. A change in price does not affect the current paid period.
5.4. Payment through an App Store
5.4.1. When a subscription is taken out in the Application through an app store (App Store, Google Play), payment is made by means of the relevant store at the price stated in the store.
5.4.2. Renewal, disabling renewal and cancellation of a subscription purchased through an app store, and refunds for it, are governed by clause 5.6.9.
5.4.3. A subscription taken out through an app store is valid in the Service in the same way as a subscription paid from the Wallet.
5.5. Refunds and Right of Withdrawal
5.5.1. AI² tokens credited to the User’s balance are not exchanged back into money, except in the following cases:
• technical malfunctions of the Platform, confirmed by the Administration;
• double billing due to a Platform fault;
• exercise of the right of withdrawal in accordance with clause 5.2.3;
• other cases provided by applicable consumer protection legislation.
This rule applies only to exchanging AI² tokens back into money and does not restrict refunds of the subscription price in AI² tokens to the Wallet under clauses 5.6.6–5.6.8.
5.5.2. Monetary refunds (where applicable) are issued using the same payment method used for the original payment, within 14 (fourteen) days from the date of approval of the refund request.
5.5.3. To request a monetary refund, the User must contact support@allyon.ai, stating the reason for the refund and the transaction details. A refund for a subscription taken out through an app store is requested from the relevant store (clause 5.4.2).
5.5.4. Consumers from EU countries may also contact the alternative dispute resolution (ADR) body or the consumer protection authority of their country of residence.
5.6. Subscriptions and Automatic Renewal
5.6.1. Subscription. Paid features of the Service are provided by subscription. The User selects the subscription term when subscribing: 1, 3, 6 or 12 months.
5.6.2. Payment and Wallet. The subscription is paid for in AI² tokens from the Wallet of the Service. The Wallet of the Service is separate from the wallets of the Operator’s other services: funds in one service are not used to pay for another.
5.6.3. Automatic renewal. At the end of the paid period, the subscription renews automatically for the same term at the price applicable on the renewal date, by debiting the Wallet of the Service. The User receives notice of the upcoming renewal 3 (three) days before the end of the paid period.
5.6.4. Insufficient funds. If the Wallet balance is insufficient on the renewal date, no debit is made, the User is notified, automatic renewal is disabled, and access to paid features ends at the end of the paid period. Topping up the Wallet after this does not automatically reactivate the subscription — the User must subscribe again.
5.6.5. Disabling renewal. The User may disable automatic renewal at any time in the “Subscription” section. The paid period remains in effect until its end; no refund is made.
5.6.6. Cancellation of the subscription. The User may cancel the subscription at any time. Upon cancellation, access to paid features ends immediately, and AI² tokens are refunded to the Wallet from which payment was made:
- if no more than 24 (twenty-four) hours have elapsed since payment — the full price of the paid period;
- if more time has elapsed — the price of the unused portion of the paid period, in proportion to the time remaining.
5.6.7. Account deletion. Upon deletion of the account or removal of the Service from the account, the active subscription is cancelled in accordance with clause 5.6.6.
5.6.8. Blocking. If the account is blocked for a breach of this Agreement, the active subscription ends and the price of the unused portion of the paid period is refunded to the Wallet of the Service.
5.6.9. App stores. A subscription purchased through App Store or Google Play is renewed, has renewal disabled, and is cancelled in the subscription settings of the relevant store; refunds are subject to that store’s rules.
5.6.10. Consumer rights. This section does not restrict the User’s rights under applicable consumer protection law. This includes the right to withdraw from the contract within 14 days under Directive 2011/83/EU, insofar as that right has not ended as a result of the User’s consent to the immediate commencement of the service.

6.5.4. In accordance with the DSA, the User has the right to apply to a certified out-of-court dispute settlement body if dissatisfied with the outcome of the internal appeal procedure.
6.6. Complaints and Blocking

The User has the right to file a complaint about another User or about content that violates these Rules using the "Report" action in a profile or conversation (including with the reasons "Minor" and "Inappropriate content") or by email: support@allyon.ai. The "Block" action stops the receipt of messages from the blocked person.
6.6.2. The Administration reviews complaints within a reasonable timeframe (typically within 5 business days) and informs the complainant of the review results.

7.2. The User does not acquire any intellectual property rights to the Service or its components, except for the right to use the Service within the scope of the granted license (Section 4).
7.3. By posting content in the Service (profile photo, "About me" text, messages, attachments, notes), the User grants the Operator a non-exclusive, royalty-free, worldwide license to use such content solely for the purpose of providing the Service, including generating the AI companion's replies, displaying content to the User's contacts in the "Friends" section (to the extent sent to them by the User), technical processing and storage.
7.4. The said license terminates upon deletion of the content by the User or deletion of the Account, except for messages sent by the User to other people in the "Friends" section (clause 3.6.5) and except for anonymized statistical data.
7.5. The User warrants that the content posted by them does not infringe upon the intellectual property rights of third parties. In the event of claims by third parties in connection with the use of the User's content, the User undertakes to independently settle such claims and to indemnify the Operator for all losses incurred.
7.6. The AI companion's replies are provided to the User for personal use. The Operator does not guarantee the uniqueness of the replies or the absence of matches with third-party materials.
7.7. Reverse engineering of the software components of the Service, including the mechanisms for generating replies, the companion's memory and AI models, is prohibited and may give rise to civil liability in accordance with applicable law.
8. AI SERVICES, AI COMPANION AND TRANSPARENCY
8.1. Nature of the Service
8.1.1. The main function of the Service is the User's dialogue with a software companion based on a large language model.
8.1.2. The AI companion is not a human being. The User has been informed and agrees that all replies, including those voiced aloud, are generated automatically by software. The AI companion is clearly identified in the Service as artificial intelligence in accordance with the transparency requirements of Regulation (EU) 2024/1689 (EU AI Act).
8.1.3. The AI companion's replies are informational and entertainment in nature and do not constitute medical, psychological, legal, financial or other professional advice. The Operator does not guarantee their accuracy, completeness or applicability to the User's circumstances.
8.1.4. Where there are signs of a threat to life or health, the Service may show the User the contacts of specialized help services. The Service does not provide emergency assistance and does not replace contacting specialists and emergency services.
8.2. What Data the AI Companion Uses
8.2.1. The following are used to generate a reply:
• the text of the current conversation and recent messages of the dialogue;
• the companion settings chosen by the User;
• information from the companion's memory (if memory is enabled);
• the recognized text of voice messages and the content of attachments sent by the User;
• the interface language and time zone (for reminders).
8.2.2. The AI companion's replies are generated by the Operator's own language models running on the Operator's servers, through the Operator's internal Mars LLM Service. Conversation data is not transferred to third-party artificial intelligence service providers.
8.2.3. The content of correspondence with the AI companion is not used to display advertising and is not transferred to third parties beyond what is stated in the Privacy Policy.
8.3. Transparency of Personalization Technologies
8.3.1. In accordance with the transparency principles established by GDPR and Regulation (EU) 2022/2065 (DSA), the Operator informs Users about the technologies used to generate replies (recommender technologies).
8.3.2. The Service applies personalization technologies solely to generate the AI companion's replies in the dialogue with the User. Data used: the text of the conversation, the companion settings, the companion's memory, the interface language, and technical information about the device necessary to display the reply.
8.3.3. Not used for personalization: information on racial and ethnic origin, political opinions, religious beliefs, health and intimate life, as well as biometric data. If the User personally shares such information in a conversation, it is used only for the reply in that conversation and may be kept in the companion's memory within the limits specified in clause 3.3 and in the Privacy Policy.
8.3.4. The Service has no matching of people, profile ratings, "like" marks, search filters or any mechanisms for Users to get acquainted with one another. No content feed or profile ranking is applied in the Service.
8.3.5. The User has the right to opt out of memory-based personalization by disabling the companion's memory in the settings of the Service (clause 3.3.2). Generating the AI companion's replies based on the text of the conversation is the essence of the service: if the User objects to it, the Service cannot be provided; in this case, the User has the right to delete the conversation history or the Account.
8.3.6. The rules for applying recommender technologies are additionally published in the Service in a separate document.
8.4. Automated Decision-Making and Profiling
8.4.1. In accordance with Art. 22 of GDPR, the Operator informs the User of the following types of automated data processing:
• generating the AI companion's replies taking into account the course of the conversation and the companion settings;
• saving information in the companion's memory to personalize replies;
• creating reminders at the User's request;
• speech recognition and voicing of replies;
• automated anti-abuse measures (limiting the frequency of requests and the number of sign-in attempts, tracking the free-mode limit).
8.4.2. Automated processing is not used to make decisions that produce legal effects for the User or similarly significantly affect the User. Decisions to block an Account are made by the Administration with human involvement.
8.4.3. In accordance with Art. 22(3) of GDPR, the User has the right to:
• contest the results of automated processing;
• request human involvement in the decision-making process;
• express their point of view.
8.5. Limitations
8.5.1. The Operator does not guarantee the uninterrupted operation of the language models or of the speech recognition and synthesis services; in the event of technical failures, the AI companion's replies may be temporarily unavailable.
